  1. These terms apply to all incursions or workshops booked by a School or other educational or training institution or organisation (the School) to be delivered by Story Squad and its officers, employees and contractors.
  2. By booking a Story Squad School incursion or workshop, the School acknowledges and agrees to these terms and conditions on behalf of the School, its staff, students and/or other participants.
  3. All bookings are subject to availability and are confirmed only upon the School’s written approval of quotation.
  4. Supervision and Duty of Care: The School retains duty of care and behaviour management responsibility for students at all times. A teacher or authorised School staff member must remain present for the full duration of the incursion. The Story Squad facilitator provides instruction only and will not supervise students independently.
  5. Story Squad facilitators reserve the right to refuse or discontinue participation for any student who poses a disciplinary problem, a threat to others, or who disrupts the learning experience.
  6. Story Squad reserves the right to amend programs, facilitators, schedules, and pricing where necessary. In the event that an incursion is cancelled by Story Squad for any reason and cannot be rescheduled, the School will be notified as soon as possible and, if relevant, a full refund will be provided. Story Squad will not have any further liability to the School for the cancellation.
  7. While we aim for consistency, Story Squad reserves the right to change facilitators without notice.
  8. All Story Squad facilitators hold a current NSW Working with Children Check. Story Squad staff follow School child protection and reporting procedures.
  9. Photography and videography: Photographs or video recordings may be taken during the workshop for educational or promotional purposes. Unless Story Squad is advised to the contrary in writing prior to an incursion or workshop, the School hereby grants permission for Story Squad to do so. Any images in which a student is identifiable will only be used where prior parental/guardian consent has been obtained in accordance with the School’s policies and requirements. The School is responsible for managing and confirming consent. Where consent has not been obtained, or is unclear, all student identities will be obscured or the student will not be photographed or recorded.
  10. Intellectual Property: Story Squad owns or is licensed to use all intellectual property in all materials created or used in connection with an incursion or workshop, including any modification, development or enhancement of material in which intellectual property rights exist (Materials). Story Squad hereby grants to the School a limited, royalty-free, non-exclusive license to use or reproduce the Materials solely for the purposes of Story Squad delivering an incursion or workshop at the School and for no other purpose. Except for this limited licence, the School acknowledges that nothing in these terms and conditions confers or gives rise to any rights in or ownership of the Materials in favour of the School or its staff, students and/or other participants.
  11. The School indemnifies Story Squad for any loss, liability, claim, damage or expense incurred by Story Squad arising from or in connection with a breach by the School or its staff, students and/or other participants of clause 10 or any use of the Materials not otherwise permitted in writing by Story Squad.
  12. Story Squad does not operate incursions on public holidays unless otherwise agreed.
  13. While Story Squad endeavours to be flexible with incursion dates and times, requests to reschedule an incursion due to student or School absence, timetable changes, or other circumstances are subject to availability and must be made with at least twenty (20) business days’ prior notice. If an incursion is unable to be rescheduled within 3 months of the original scheduled time then it will be deemed a cancellation and clauses 13 and 14 will apply.
  14. Bookings may be transferred to another student year group within the same School, subject to availability and agreement by Story Squad. If a booking needs to be transferred the School / institution must advise Story Squad at least ten (10) business days prior to the scheduled incursion date. If a request to transfer a booking is made less than ten (10) business days prior to the scheduled incursion date, the School acknowledges that a new program and materials may need to be created and agrees to pay Story Squad’s additional costs as notified to the School (minimum $300).
  15. Cancellations made by the School at least ten (10) business days prior to the scheduled incursion date may be eligible for a refund of any pre-paid amount. In addition, the School agrees to pay an administration fee of $150 (which may either be deducted from any refund payable or invoiced separately).
  16. Cancellations made by the School less than ten (10) business days prior to the scheduled incursion date, regardless of the circumstances (including but not limited to  illness, staffing changes, or unforeseen events) are not eligible for a refund. In addition, the School agrees to pay for any costs reasonably incurred by Story Squad for any specialist program developed and materials prepared, plus an administration fee of $150.
  17. To the extent permitted by law, Story Squad and its officers, employees, agents and contractors are not liable for any personal injury, property damage, loss, or liability suffered by the School and any student, parent/guardian of a student, staff member, or visitor arising from or in connection with a Story Squad incursion or workshop, except where caused by proven negligence or wilful misconduct by Story Squad.
  18. Story Squad is not responsible for lost or damaged student work. Responsibility for collection and storage of student work rests with the School following the session.
  19. In the event of a medical emergency during an incursion, including illness or injury, the teacher and School staff are responsible for managing and administering first aid. Story Squad staff will follow the School’s emergency procedures. The School remains responsible for all medical care, consent and related expenses.
  20. Story Squad maintains booking and contact information on a confidential database and may use this information to communicate with Schools regarding programs, updates, and marketing (unless requested otherwise).
  21. Privacy Statement:
    Story Squad collects personal information in accordance with the Privacy Act 1998. Information may include names, contact details, and booking information. This data is used solely for administrative and communication purposes and is not shared with third parties. All photographs and recordings will be handled in accordance with applicable privacy laws and Department of Education requirements. Payment information is processed securely and is not stored by Story Squad.
  22. Story Squad reserves the right to amend these terms and conditions at any time. Updated terms will take effect immediately upon publication on the website or, where the School already has an incursion booked with Story Squad, upon notification in writing to the School.
  23. These terms and conditions contain the entire understanding between the parties in relation to the services provided by Story Squad, and supersede any previous agreements, understandings, negotiations or arrangements (whether written or oral) in respect of the services.
  24. If a particular term of these terms and conditions is not enforceable, it should be modified so as to be enforceable, but regardless will not affect any other terms. Story Squad’s failure to act upon a breach of these terms and conditions does not mean we waive any rights that we may have.
  25. These terms and conditions shall be governed by and construed in accordance with the laws of the state of New South Wales, Australia. The parties agree to submit to the non-exclusive jurisdiction of the courts of New South Wales.
